Welcome to ECT ("we", "us", "our"). By using our service to book a UK driving test on your behalf, you (the "customer", "learner", "you") agree to be bound by these Terms & Conditions. Please read them carefully before submitting your booking.
1. Who we are
ECT is an independent test-finding service. We help learners find and secure earlier available slots for their UK practical driving test at their chosen test centre.
2. What our service does
When you submit a booking through our website, you authorise us, as your agent, to act on your behalf to:
- Help you find an earlier available driving test slot at your chosen test centre within your selected months;
- If a suitable slot becomes available, notify you by text message (SMS) and ask for your explicit confirmation;
- If you confirm, complete the booking on your behalf using the information you have provided to us;
- Send you a confirmation containing the date, time, centre, and payment details for the test fee due.
We act as your authorised agent solely for the purposes set out above. You may revoke this authorisation at any time by replying CANCEL SEARCH to any text message we send you, or by messaging us via the live chat on our website.
3. Your authorisation, declaration and warranties
By submitting a booking, you expressly:
- Authorise us as your agent to act on your behalf when booking your driving test, using the personal information you have provided, for the limited purpose of finding and booking your test;
- Warrant that you are the learner driver named in the booking and that all information you have provided (name, address, licence number, theory certificate number, photograph) is true, accurate, and current;
- Acknowledge that any declaration made to DVSA in connection with your booking ("I confirm I am the learner") is your declaration, made through us as your agent on your express instruction. You alone are legally responsible for the truthfulness of that declaration;
- Confirm you are legally eligible to take a UK driving test (e.g. you hold a valid UK provisional driving licence and a valid theory test pass).
4. DVSA rules and cancellation risk
If your test is cancelled by the DVSA after we have booked it on your behalf, we will:
- Notify you as soon as we are made aware of the cancellation;
- Where the DVSA refunds its own test fee (the amount DVSA charged for the slot) to us, pass that refund on to you within 14 days;
- Retain our service fee, as our service (finding and securing your test slot) has already been delivered.
5. Pricing and payment
You pay nothing upfront. Payment is requested only after we have successfully booked a test on your behalf. The total includes DVSA's published test fee for the slot we book, plus our fee for finding and securing it.
The exact total you will pay is shown to you on the booking form, in the slot-found text message, and in the booking-confirmation text message before any payment is made.
Payment is made via the secure payment link sent in the booking-confirmation text message. We accept card payments, Apple Pay and Google Pay. We do not accept cash.
6. Refunds
Because no payment is taken before the test is booked, there is nothing to refund if:
- We cannot find a slot in your selected months (you simply pay nothing); or
- You cancel your search before a slot is found.
After payment is received, our service has been delivered. The following non-refund policy applies:
- If the DVSA cancels your test: our service fee is non-refundable. We will pass on any DVSA refund as described in section 4 above.
- If you fail or do not attend the test: no refund is due.
- If you cancel the test yourself after we have booked it on your behalf: no refund of our service fee. Any DVSA refund (subject to DVSA's own rules) is your responsibility to claim directly from DVSA.
7. Indemnity
- Any breach by you of these Terms & Conditions;
- Any inaccurate or misleading information you have provided to us;
- Any action taken by the DVSA, DVLA or any UK authority against you or against your test booking;
- Your use of, or inability to use, our service.
8. Limitation of liability
Our total aggregate liability to you in connection with our service, however arising, is limited to the amount you have actually paid us in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or special losses, including but not limited to loss of profits, loss of opportunity, or distress.
Nothing in these Terms & Conditions limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law.
9. Your data
We collect and process the personal information you provide (name, address, contact details, licence number, theory certificate number, licence photograph) for the sole purpose of providing you with our service. We do not sell or share your data with anyone else except as strictly necessary to deliver our service. Full details are in our Privacy Policy.
We retain your data only as long as is necessary to provide the service, comply with our legal obligations (such as tax records), or defend legal claims. You have the right to request a copy of your data, correction of inaccurate data, and erasure (subject to our legal record-keeping obligations) by messaging us via the live chat on our website.
10. Cancellation and termination
You may cancel your search at any time before a test has been booked by replying CANCEL SEARCH to any text message we send you. Cancellation takes effect immediately and you owe no payment.
We reserve the right to refuse or terminate service at our discretion, including (but not limited to) where the information provided is inaccurate, where we suspect fraudulent use, or where continuing the service would breach applicable law.
11. Changes to these terms
We may update these Terms & Conditions from time to time. The current version will always be available on our website. Material changes will be notified to you by text message or at the time of your next booking.
12. Governing law and jurisdiction
These Terms & Conditions are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Message us
If you have any questions about these Terms & Conditions or about our service, please message us via the live chat on our website.
